1. Acceptance of Terms

By downloading, installing, or using the Katemba POS application ("Katemba", "App", "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the App, including business owners, managers, and cashier staff members.

2. Description of Service

Katemba is a point-of-sale application that allows businesses to:

• Process sales transactions using cash and mobile money
• Manage product inventory and stock levels
• Create and manage staff accounts with role-based permissions
• View sales reports and business analytics
• Operate across multiple store locations (Professional plan)
• Work offline with automatic data sync when connectivity is restored

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use Katemba, you must create an account with a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring that any staff accounts you create are used only by authorised individuals
• Notifying us immediately of any unauthorised access to your account

You must be at least 18 years old to create an account. By registering, you confirm that all information you provide is accurate and up to date.

4. Subscription Plans & Billing

Starter Plan (Free)
Available at no cost. Includes 1 store, up to 100 products, basic reporting, and email support.

Professional Plan
Billed quarterly at ZMW 225. Includes up to 5 stores, unlimited products, advanced analytics, staff management, discount codes, and priority support.

Subscriptions are processed via mobile money (MTN, Airtel, or Zamtel). By initiating a payment, you authorise Katemba to charge the stated amount to your mobile money wallet.

We reserve the right to change subscription prices with at least 30 days' notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

5. Acceptable Use

You agree to use Katemba only for lawful business purposes. You must not:

• Use the App to process fraudulent or unauthorised transactions
• Attempt to reverse-engineer, decompile, or modify the App
• Use automated scripts or bots to access the Service
• Interfere with or disrupt the security or integrity of our servers
• Use the Service to store or transmit illegal content
• Resell or sublicense access to the Service without our written consent
• Impersonate another business or individual within the App

Violation of these rules may result in immediate suspension or termination of your account.

6. Data Ownership

You retain full ownership of all business data you enter into Katemba, including products, transactions, customer records, and staff information.

You grant Katemba a limited, non-exclusive licence to store, process, and transmit this data solely for the purpose of providing the Service to you.

You can export your transaction data at any time from the Settings screen. Upon account deletion, your data will be permanently removed from our servers within 30 days.

7. Intellectual Property

All intellectual property rights in the Katemba application, including its design, code, logos, trademarks, and content, belong to Katemba. Nothing in these Terms grants you any rights to our intellectual property beyond the limited right to use the App as described herein.

8. Availability & Downtime

We strive to keep Katemba available at all times, but we do not guarantee uninterrupted access. Planned maintenance, software updates, or circumstances beyond our control may cause temporary downtime.

Because Katemba functions offline, short periods of server unavailability will not prevent you from processing sales. Your data will sync once the connection is restored.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Katemba disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be error-free, that defects will be corrected, or that the App is free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Katemba and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of business data
• Costs of substitute services
• Damages arising from unauthorised access to your account

Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the Service in the three months preceding the claim.

11. Termination

You may stop using Katemba at any time. You can request account deletion by contacting support@katemba.app.

We may suspend or terminate your account without notice if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including data ownership, liability, and disputes) will remain in effect.

12. Governing Law

These Terms are governed by the laws of the Republic of Zambia. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Zambia.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via in-app notification or email at least 14 days before they take effect.

Your continued use of the Service after the revised Terms take effect means you accept the updated Terms. If you do not agree, you must stop using the Service and may request account deletion.
